Terms and Conditions

These Terms and Conditions ("Terms") govern your use of mirachtechnologies.com (the "Website") and any services provided by Mirach Technologies ("we", "us", "our"). By using the Website or engaging our services you agree to these Terms.

1. Services

We provide software development, design, digital marketing and related technology services. The scope, deliverables, timelines and fees for each engagement are set out in a separate proposal, statement of work or agreement ("Agreement"). If an Agreement conflicts with these Terms, the Agreement prevails.

2. Quotes and payments

Quotes are valid for 30 days unless stated otherwise. Invoices are payable within the period stated on the invoice. Late payments may pause work. All fees are exclusive of applicable taxes (including GST), which are charged as required by law.

3. Client responsibilities

You agree to provide accurate information, timely feedback, content and access needed to deliver the services. Delays in providing these may affect timelines and fees.

4. Intellectual property

On full payment, ownership of the final deliverables created specifically for you transfers to you, unless the Agreement says otherwise. We retain ownership of our pre-existing tools, libraries and know-how, and grant you a licence to use them as part of the deliverables. Third-party and open-source components remain subject to their own licences.

5. Portfolio

Unless you ask us in writing not to, we may mention you as a client and show non-confidential parts of the work in our portfolio.

6. Confidentiality

Each party will keep the other's confidential information private and use it only to perform the engagement.

7. Warranties and liability

We perform services with reasonable skill and care. Except as expressly stated, the Website and services are provided "as is". To the maximum extent permitted by law, our total liability arising from an engagement is limited to the fees paid for that engagement in the three months before the claim, and we are not liable for indirect or consequential losses.

8. Use of the Website

You agree not to misuse the Website, attempt unauthorised access, or use it for unlawful purposes. Content on the Website is for general information and may change without notice.

9. Third-party links

The Website may link to third-party sites. We are not responsible for their content or practices.

10. Governing law

These Terms are governed by the laws of India. Courts at our registered place of business have exclusive jurisdiction.

We may update these Terms. The "last updated" date on this page shows when they last changed.
